Terms & Conditions

1. Services

CPM provides real estate photography, drone photography, floor plans, virtual twilight images, image enhancement services, property marketing media, and related services.

All services are subject to availability, weather conditions, site conditions, and operational requirements.

2. Booking and Payment

Payment is due according to the terms provided at booking.

Invoices not paid by the due date may be subject to late fees, service suspension, withholding of media delivery, or cancellation of future bookings.

CPM reserves the right to require payment before delivery of final media.

3. Property Readiness

The client is responsible for ensuring the property is ready for photography upon arrival.

This includes:

• Cleaning and staging the property
• Removing personal items if desired
• Securing pets
• Ensuring utilities are active
• Ensuring all areas to be photographed are accessible

CPM is not responsible for moving furniture, cleaning, staging, organizing belongings, landscaping, or preparing the property.

Additional fees may apply if the property is not ready upon arrival and additional time is required.

4. Weather and Rescheduling

Photography and drone operations are subject to weather conditions.

CPM reserves the right to reschedule services due to weather, unsafe conditions, equipment issues, airspace restrictions, or circumstances beyond our control.

Clients may request rescheduling subject to availability.

5. Cancellations

Appointments canceled less than 24 hours before the scheduled shoot may be subject to a cancellation fee.

If CPM arrives at the property and is unable to complete the service due to client-related issues, property access issues, or property readiness issues, a trip fee or cancellation fee may apply.

6. Drone Operations

Drone services are performed in compliance with applicable Federal Aviation Administration (FAA) regulations.

Drone services may be modified, limited, or canceled due to:

• Weather conditions
• Airspace restrictions
• Temporary flight restrictions
• Safety concerns
• Property conditions
• Regulatory requirements

No guarantee is made that drone services will be available at every property.

If drone operations cannot be completed safely or legally, CPM may provide alternative ground-based imagery or issue an appropriate adjustment at its discretion.

7. Delivery

Final media is delivered electronically.

Delivery times are estimates and not guarantees.

CPM is not responsible for delays caused by weather, internet outages, software failures, third-party service providers, force majeure events, or circumstances beyond our control.

8. Gallery Availability

Delivered galleries are generally available for 30 days following delivery.

Clients are responsible for downloading and backing up all media before gallery expiration.

CPM does not guarantee permanent storage or future availability of delivered files.

Requests for file recovery after gallery expiration may not be possible and may incur additional fees.

9. Floor Plans and Measurements

Floor plans provided through CPM may be generated using third-party technology and should be considered approximate.

Floor plans, dimensions, square footage estimates, and measurements are provided for marketing purposes only.

Clients should independently verify any measurements before relying on them for legal, financial, construction, appraisal, permitting, or real estate transaction purposes.

CPM makes no warranty regarding the accuracy of measurements or floor plan data.

10. Property Information

Clients are responsible for verifying the accuracy of all property information used in marketing materials.

CPM is not responsible for errors in listing information, property descriptions, measurements, pricing, disclosures, or other information supplied by the client or third parties.

11. Copyright and Ownership

All photographs, videos, floor plans, edited media, and related content created by CPM remain the intellectual property and copyrighted work of Constantine Property Group LLC unless otherwise agreed in writing.

No ownership rights are transferred to the client.

12. License to Use Media

Upon full payment, CPM grants the client a non-exclusive, non-transferable license to use delivered media for marketing, advertising, listing, promotional, and business purposes related to the property.

Media may not be sold, sublicensed, transferred to unrelated third parties, used in stock photography collections, used for AI training, or otherwise redistributed without written permission from CPM.

13. Portfolio and Promotional Use

Unless otherwise agreed in writing, CPM may use photographs, videos, floor plans, and related media created during a project for:

• Portfolio display
• Website content
• Social media
• Advertising
• Marketing materials
• Educational or promotional purposes

Clients requesting restrictions on portfolio use must notify CPM in writing before the scheduled shoot.

14. Limitation of Liability

To the maximum extent permitted by law, CPM's total liability arising from any service, booking, project, or claim shall not exceed the amount paid by the client for the specific service giving rise to the claim.

CPM shall not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.

15. Indemnification

Clients agree to defend, indemnify, and hold harmless Constantine Property Group LLC, Constantine Property Media, its owners, employees, contractors, and agents from claims, damages, losses, liabilities, costs, and expenses arising from:

• Property access provided by the client
• Property conditions
• Client-provided information
• Client misuse of delivered media
• Violations of applicable laws or regulations

16. Force Majeure

CPM shall not be liable for delays or failure to perform caused by events beyond reasonable control, including weather, natural disasters, internet outages, equipment failures, government actions, labor disputes, acts of God, or other unforeseen circumstances.

17. Governing Law

These Terms shall be governed by and construed under the laws of the State of Georgia, without regard to conflict of law principles.

18. Changes to These Terms

CPM may update these Terms from time to time. The version in effect at the time of booking shall govern the services provided.
